Terms of Service — Key Clauses

Our full Terms of Service govern every booking, quote and contract. Summary below; full terms supersede this summary where they conflict.

A booking is accepted when confirmed in writing by Choicepulse. Quotes expire as stated; rates may change for delays, fuel surcharges, or regulatory fees.

Payment terms appear on invoices. Choicepulse may require deposits or security for high-risk shipments. Unpaid accounts may incur interest and collection costs.

Choicepulse is not liable for delay where caused by events outside our control (force majeure). Carriage is subject to applicable international conventions and carrier conditions where relevant.

Standard carriage does not include full-value insurance. Customers may purchase insurance or declare higher value for carriage; evidence required for claims.

NZ consumer protections

If you are a consumer, certain guarantees under the Consumer Guarantees Act 1993 (CGA) apply and cannot be excluded. These include guarantees as to acceptable quality and fitness for purpose.

Consumer Guarantees & Fair Trading

Under New Zealand law (CGA), consumers have non‑excludable rights when buying services for personal use. Our Terms do not exclude these guarantees. For business-to-business contracts, parties may agree different protections consistent with law.

  • Faulty service — customers may be entitled to remedies including repair, repeat service or refund.
  • Misleading claims — where appropriate, the Fair Trading Act 1986 applies to representations about services.

If you are unsure how the CGA applies to your booking, contact our support team.

Liability, limits and exclusions

Where permitted by law, Choicepulse's liability for loss or damage is limited. The table summarises typical caps for different service categories; specific carrier terms may apply and take precedence.

Service Typical liability cap Notes
Domestic courier NZD 200 per consignment Unless higher declared value purchased
Freight forwarding (road/sea) Carrier terms or NZD 2.00/kg Subject to international/regional conventions
Warehousing & handling NZD 100 per pallet Limited for perishable goods

These caps are illustrative. They do not reduce your statutory rights where law prohibits exclusion or limitation of liability.

Customs, duties & hazardous goods

Customers are responsible for correct documentation and declarations. Import duties, taxes and customs clearance charges are payable by the consignee unless otherwise agreed. Hazardous or restricted goods must be declared; non‑declaration may void cover and attract penalties.

  • We provide brokerage support on request — fees apply.
  • Prohibited goods cannot be accepted for carriage into or within New Zealand.

Complaints, disputes & governing law

If you have a complaint, please contact Choicepulse at Choicepulse@outlook.com or via our contacts page. We aim to acknowledge and resolve complaints promptly.

These Terms are governed by the laws of New Zealand. Parties submit to the exclusive jurisdiction of New Zealand courts unless otherwise agreed in writing. Alternative dispute resolution may be offered where appropriate.
